
J Waivers
J Waivers are special exceptions for those who are approved for entry into the U.S. under a J Visa. Usually, these visitors are required to leave the country for no less than two years after their return home or upon completion of their work or education within the United States. A J Waiver allows that requirement to be waived for those who are approved. There are five ways that a person can obtain this waiver:
- A statement of 'No Objection' from the home government. This is not available to students who are sponsored in the U.S. by the Educational Commission for Foreign Medical Graduates.
- A request from U.S. Government agencies with interest on behalf of the person
- A claim that the person cannot return to their home country without facing persecution A declaration of extreme hardship to a spouse or child that is a U.S. citizen or permanent resident if the person is required to return to their home country.
- A request placed by state public health department or an equivalent party on behalf of the person in question. This rule ONLY applies to graduates who obtained a J-1 Visa for the purpose of medical education or training at the graduate level.
