Medical Malpractice
Dealing with medical malpractice cases can prove to be intimidating and strenuous for the victim, partially because of the devastating consequences that occur as a result of medical malpractice and/or negligence. Gabriel Assaad has the experience required to help you work through the ins and outs of your case. He has an extensive background of dealing with medical malpractice cases in Washington D.C., Virginia and Maryland.
Medical malpractice, also known as medical negligence, is negligence committed by a health care provider in which the care provided diverged from the accepted standards of practice in the medical community and causes injury or death to the patient. Medical professionals are required to maintain professional liability insurance to offset the risk and costs of lawsuits based on medical malpractice. There are four elements that must be established for a medical malpractice claim to be successful:
- Duty: the health care professional owes the patient reasonable and appropriate care
- Breach: the health care professional has deviated from or fallen below reasonable and appropriate care
- Causation: the health care professional’s deviation from reasonable and appropriate care caused or contributed to the harm, injury and/or death of the patient
- Damages: the patient was a victim of harm, injury and/or death because of the health care professional’s mistake
